- ItemThe Impact of Social – Political Context Within the OPT in 1967 on Constructing A Palestinian Model of Transitional Justice(2016) Nour Nihad Muhammed Mujahed; Dr. Raed NeiratThis study wich consists of four chapters addresses the Socio-political contexts in the Occupied Palestinian Territories and it is impact on building Palestinian model for Transitional Justice supportive of national liberation and democratic construction, and addresses the requirements needed for building this model, limits of liability and the roles of the application. The problem of the study lies in the absence of a Palestinian perspective of social and political contexts influence, which including supporting the national projectis supposed to work on investment, and threats represent a challenge to achieve freedom and independence require confrontation to reduce the negative effects For this purpose, the study puts down a number of questions regarding the supportive and disruptive Palestinians socio-political contexts in building a Palestinian model for transitional justice. In addition to this, the study lies questions about the Palestinian political context effectiveness in the field of building the Palestinian model for transitional justice, the values to be converted and the other to be installed before starting the Palestinians model in transitional justice, the institutional and national responsibility limits in the application of this model and the role of civil society institutions in the application of this model. The study hypothesizes that the Palestinian socio-political contexts incubator to build a supportive transitional justice model to achieve Palestinian unity, strength of the democratic structure and national liberation, while the Palestinian political context hinders the construction of this model. The study adopted the descriptive analytical method to answer the questions and examine the hypothesis, where it was used the following tools: Questionnaire, interviews. The importance of the study lies in light of the continued status of the Palestinian fragmentation, the growing challenges that beset the national project as a whole, and it is impact on achieving Palestinian national goals, the march of the democratic structure, and the need to won a Palestinian model in the transitional justice texture of national unity and supportive of national liberation and democratic construction. The study has come up with a number of results most notably the lack of Palestinians effectiveness of social- political contexts and the ineffectiveness of the Palestinians political contexts in the field of building a Palestinian model in transitional justice texture national unity. Palestinian model in transitional justice has been developed according to the results of the study. Main recommendation have been suggested according to the study results: 1. Pressure campaigns carried out by the parties and civil society organizations for the implementation of the reconciliation agreements and achieve national unity as a requirement for the application of the proposed model.
- ItemPalestine Diplomatic Role in Influencing the Attitudes and Policies of the EU Towards the Process of Political Development in Palestine (2005-2013)(2015) Anas Taiseer Abd Salahat; Dr. Raed NeiratThis study aims to examine the effects of Palestinian diplomacy on the positions and the role of the European Union in regard to the political development process in Palestine, through the lenses of the EU developmental role in Palestine. It also shed light on the EU vision of development and the obstacles it faces, and it seeks to overcome to reinforce this role. On the Palestinian side, the study seeks to clarify the Palestinian Authority's vision of development, and to understand the prospects and the limits of Palestinian diplomacy in affecting the EU role and the challenges this diplomacy faces in this respect. Assessing the mechanisms Palestinian diplomacy deploys in order to develop EU role in the development of Palestinian political processes. Thus, the study evaluate strengths and weaknesses, and successes and failures of this diplomacy. The study departs from a hypothesis that says that Palestinian diplomacy suffers from weakness in affecting EU positions and policies in the realm of political development in Palestine. This weakness manifests in the inability of this diplomacy to compel the EU to turn its declared positions into actual policies that travels beyond EU own interests that often takes Israeli demands and conditions as the limits within which the EU acts. There are four main aspects through which this study proceeds: the first is the theoretical and conceptual; the second traces the origins and the development of Palestinian diplomacy and its main traits, especially in the aftermath of the Oslo Accords of 1993. The third aspect analyzes the development of the EU positions toward the "peace process" and political development of the PA. Finally the study discusses the extent to which Palestinian diplomacy has affected EU policies in developing Palestinian political life. In the conclusion the study submits that the EU role in development is way larger that its role in the political arena. The EU is the largest financial supporter to the Palestinians through the PA. The objective of this assistance is reinforce and support the political process. In this regard, Palestinian diplomacy has accomplished some successes in developing EU political and developmental roles in Palestine. The most important areas of weakness of Palestinian diplomacy is that it couldn't make the EU cash out its verbal positions into practical policies that contribute to the political development in Palestine, especially in regard to the achievement of a Palestinian state. The study notices, by way of recommendation, that there is a basic need to develop and reinforce the performance of Palestinian diplomacy toward the EU. This includes the reinforcement and increasing the diplomatic cadre working in the EU; training diplomatic personnel in EU countries; and to adapt and implement a grand Palestinian diplomatic strategy with clear objectives, tools and mechanism. Such a diplomacy must match the importance of the EU, and the unique situation in Palestinian.
- ItemPalestinian Local Government Election of (2004/2005), 2012: Results and Indecations, A Comparative Study(2015) Ali Qasem Mohammad Mansour; Dr. Raed NeiratThe objective of the study is to compare between the first local election (2004-2005) and the second ones (2012), so we can determine the effect of political environments on the results of the elections. In order to achieve this aim, the researcher used a descriptive and analytical method, in which he described the first and the second election processes based on reports, survey's and experts opinions,in addition to analyzing their outcomes then explaining them. He also used the comparison method to show similarities and differences between both elections, and to determine the factors that affected elections results . Several tools were used by the researcher, among these tools: interviews, observance and personal experience, in addition to utilizing a questionnaires that included several variables related to the performance of the councils of local bodies in several aspects, and the relationship between these variables and the mechanism in which these councils are formed, in order to give more comprehensive picture of the status of the councils that are targeted by this study. The study concluded that the existence of official, partisan and popular cover for the elections is constitutes a vital factor for the success of the election process. it also leads to a high turnout and active partisan involvement in the process. While the absence of this cover leads to negligence and low turnout among people. It also concluded that the professionalism and fairness of the supervising committee of the elections are not enough to achieve desired general goal which is to expand the contribution in decision making and strengthen a positive political culture among people. The study showed the role of the Palestinian parties retreated significantly in the daily life of people. They were less capable of rallying people to convince them to vote. It also showed differences of high statical significance between the mechanism of forming councils of local bodies on one side, and its capability, performance, fairness and the quality of its decisions on the other side. The result was in favor of the councils elected in 2004-2005. Perhaps this was due to high degree of completion at that time, which was not available in 2012. It also showed that councils that were elected by acclamation were not very different in their performance and capabilities than those were appointed by central government.
