Abstract
This thesis examines the risk insurance contract in bank loans under Palestinian Insurance Law No. (20) of 2005 and its amendments, in comparison with Jordanian and Emirati legislation. The researcher addresses the importance and concept of this contract and its legal framework in national and comparative legislation.
The study is divided into two main chapters. The first chapter addresses the concept of the risk insurance contract in bank loans and its conceptual foundations. It examines the concept of a bank loan from both economic and legal perspectives, in addition to the legislative and regulatory framework for the risk insurance contract in bank loans in comparative legislation.
The second chapter addresses the insurable interest and its conditions in the risk insurance contract in bank loans. This follows an explanation of its legal classification as a contract combining insurance and credit, as well as the legal implications of the presence of an insurable interest in the contract. Finally, the researcher discusses the reasons for the termination of the contract under study, in addition to the legal framework for claims arising from the contract in the event of the borrower's death.
