| dc.description.abstract | الملخص الحمد لله, والصلاة والسلام على رسول الله , وعلى آله وصحبه ومن والاه. أما بعد: فهذه رسالتي في المسائل التي خالف فيها الإمام الشوكاني - رحمه الله - جمهور الفقهاء في الصلاة, حيث لم أجد أحداً من أهل العلم سابقاً تفرّد في مثل هذه الحيثيّة من الدّراسة, وأسأل الله تعالى التوفيق فيها. فقد ترجمت للشوكاني - رحمه الله - وبّينت فيها اسمه, ونسبه, وألقابه، وكنيته, وسيرته العلمية والعملية, وشيوخه, وتلامذته, ووفاته, ومكانته, ومؤلفاته, كما ذكرت الحالة السياسية والدينية والاجتماعية للفترة التي عاصرها الإمام - رحمه الله تعالى-, كما وضحت منهجه العلمي, والسمات العامة لمذهبه. فالشوكاني هو أحد أبرز علماء أهل السنة في اليمن, تربى في بيت علم, فوالده من العلماء البارزين في عصره, حفظ القرآن الكريم وجوده, وحفظ كثير من المتون العلمية منذ صغره, وتعلّم على يد كثير من علماء عصره, في علوم البلاغة, وفي أصول الفقه، وفي العروض, وسائر العلوم النقلية والعقلية. وظل ينتقل بين العلماء والأمصار, حتى صار إماماً يشار إليه بالبنان، فقصده طلاب العلم والمعرفة للأخذ من علمه, حتى طار صيته في جميع البلاد، وانتفع بعلمه كثير من الناس. الشوكاني كان عالماً فقيهاً, بلغ مراتب الإجتهاد, وألّف في جميع العلوم الشرعية, فتجاوزت مؤلفاته المائة في سائر العلوم الشرعية, ودرس مسائل الخلاف في العبادات وغيرها من مسائل الفقه, اتفق مع الفقهاء في مسائل كثيرة, وخالفهم في بعضها, حيث أنّ الشوكاني - رحمه الله - عاش في فترة اضطرابات سياسية ومنهجيّة وعقائديّة, حيث سنرى في هذه الرسالة كيف أثرت تلك الفترة الزمنية في اختياراته الفقهية. جمعت في هذه الدراسة ما وقع بين يديّ من اختيارات الشوكاني في مسائل الصلاة, وما يتعلّق بها من حكم تاركها, للأذان والإقامة, والشروط والواجبات والأركان, والسنن, والمبطلات, وصلاة الجماعة, والجمعة, والإمامة, وصلاة العيدين, والكسوف, وغيرها من المسائل التي تتعلق في باب الصلاة, سواء كانت هذه الاختيارات موافقة لما اختاره الفقهاء أو مخالفة, مع بعض التوضيح عليها, كما سنرى كيف أثّرت الأصول الفقهية والمنهجيّة التي تبنّاها الشوكاني في اختياراته الفقهية. وتكللت الرسالة بالموضوع الرئيسي للدّراسة, بحيث أوردت أهم المسائل التي خالف فيها الشوكاني جمهور الفقهاء في الصلاة, مع ذكر الآراء واستدلالاتهما ومناقشتها. فأسأل الله تعالى أن يتقبل هذا العمل خالصاً لوجهه الكريم. | |

Jamal Hashash Summary Praise be to Allah, and peace and blessings be upon the Messenger of Allah , and upon his family, and those who follow him. After that: This is my dissertation on the issues in which Imam al-Shawkani - may Allah have mercy on him - disagreed with the audience of jurists in prayer, as I did not find any of the scholars previously unique in this aspect of the study, and I ask Allah Almighty for success in it. I did a biography about Al-Shawkani - may Allah have mercy on him - and indicated his name, his lineage, his surnames, his nickname, his scientific and practical biography, his sheikhs, his students, his death, his position, and his writings, as well as the political, religious and social situation of the period in which the Imam - may Allah have mercy on him - lived, as well as his scientific methodology and the general features of his doctrine. Al-Shawkani is one of the most prominent scholars of Ahl al-Sunnah in Yemen. He grew up in a house of knowledge, as his father was one of the prominent scholars of his time, memorized the Holy Quran and its existence, memorized many scientific texts from a young age, and was educated by many of the scholars of his time, in the sciences of rhetoric, the fundamentals of jurisprudence, performances, and other transmitted and rational sciences. He continued to travel between scholars and cities, until he became an Imam. Students of knowledge came to him to take from his knowledge, until his fame flew in all countries, and many people benefited from his knowledge. Al-Shawkani was a scholar and jurist, who reached the ranks of ijtihad, and wrote in all legal sciences, so his writings exceeded one hundred in all legal sciences, and studied the issues of disagreement in worship and other issues of jurisprudence, agreeing with the jurists in many issues, and disagreeing with them in some, as Al-Shawkani - may Allah have mercy on him - lived in a period of political, methodological and ideological turmoil, as we will see in this thesis how that time period affected his jurisprudential choices. In this study, I have collected what fell into my hands from Al-Shawkani's choices in matters of prayer, and what relates to it, including the ruling of those who leave it, such as the Adhaan and Iqamah, conditions, obligations, pillars, sunnah, abrogations, congregational prayer, Friday, imamah, Eid prayers, eclipses, and other matters related to prayer, whether these choices agree or disagree with what the jurists have chosen, with some clarification, and we will see how the juristic principles and methodology adopted by Shawkani affected his choices in his jurisprudential choices. The thesis culminates with the main topic of the study, in which I have listed the most important issues in which al-Shawkani disagreed with the audience of jurists in prayer, stating the opinions and their reasoning and discussing them.
