| dc.description.abstract | إن البحث في ضوابط حمل المطْلق على المقيَّد يلقى الضوء على تأثير اختلاف العلماء في القواعد الأصولية على الأحكام الشرعية، وقبل الخوض في ضوابط حمل المطْلق على المقيَّد تناولت في فصل تمهيدي حقيقة كل من المطْلق والمقيَّد وأنواعهما وحكمهما، وميَّزت بين المطْلق والعام، وبين التقييد والتخصيص، وتناولت في الفصل الأول نبذة عن الأدلة الشرعية التي تقيِّد المطْلق، وتعريفاً لقاعدة حمل المطْلق على المقيَّد وطبيعتها، وفي الفصل الثاني؛ وقفت على صور ورود المطْلق والقيَّد، ثم درست الضوابط التي وضعها الأصوليون لحمل المطْلق على المقيَّد، ومذاهبهم فيها، ودعَّمت ذلك بأمثلة لغوية وشرعية. وتضمن الفصل الأخير بعض مخرجات هذه الرسالة، وهي الأحكام الشرعية، فبحثت في بعض المسائل الفقهية، منها: تقييد صيام قضاء رمضان وكفارة اليمين بالتتابع، وقتل المرتدة عن الإسلام، وقتل النساء والأطفال في الحرب، ودِيَة المرأة في النفس وما دون النفس وتبين فيها أثر اختلاف الأصوليين في ضوابط حمل المطْلق على المقيَّد على هذه المسائل، وختمت الرسالة بأهم النتائج والتوصيات، ثم عرض فهارس الآيات والأحاديث والأعلام، ثم فهرس الكتب والمراجع. والحمد لله في البدء والختام، والصلاة والسلام على النبي المصطفى خير الأنام. | ar |
