dc.description.abstractThe oaths, an objective study of Hadith, is the title of this thesis through which the researcher aims at presenting this subject within the honored Hadiths, in order to direct Muslims to the prophetic guidance concerning the oaths, and also to show their multi view importance, clarifying their seriousness on both individuals and society, and seeking the highest exerts of care and responsibility while practising this necessary matter which is connected with a social realistic phenomenon; the abundance using of oaths by varieties of people. So this study deals with whatever concerns the oaths through the Sunnah. The researcher has used the inductive, analytic and objective methods respectively in collecting, studying, understanding and arranging the Hadiths in this study. The researcher has divided his study into an introduction and five chapters. Chapter one deals with the religious and lingual definition of oath, explaining its legitimacy, divisions, and also differentiating between the oath and the vow on the one hand, and explaining the related idioms of oath on the other hand. The researcher has concluded that the oath has diverse meanings as well as it idiomatically denotes confirmation, strengthening, and it also has various divisions reflecting the sorts of those who swear, referring to the concordant and contradictory matters between the oath and the vow. Chapter two focuses on studying of the oath cases in which prophet Mohammad(PBUH) practised, and the enunciations of oaths out of the prophetic Hadiths and clarifying some of which the prophet disallowed to involve. In chapter three, the researcher concentrated on clarifying intention and its role in the oaths, concluding that the oath depends on the one who asks for it, only if he is tyrannized. Also the researcher went into legitimacy of the oath implicatures, discussing its varieties, explaining that the retribution resulting from oaths must be with the control manifested through the honored Hadiths. Chapter four dealt with the miscellaneous issues of oaths, like duplication, fulfilling, adjuring, and excluding; coming to the conclusion that they are the prophet approach in swearing as well as means of achieving the aims of oath legitimacy. Chapter five deals with the penance; its idiomatic and lingual definition, explaining that its legitimacy aimed at making things easier for Muslims. In addition, the honored Hadiths are gracious enough with the one who penances his oath through using many available options fitting each situation, and doing like our good example, prophet Mohammad(PBUH) who did his best to seek for the best in such cases. Finally, the researcher concluded that the honored Hadiths were interested in the oaths for their great importance in Muslims' lives, especially they have early been practised by Arabs before Islam, in which they involved forms that were consistent with the Sharia, which at the same time excluded the wrong enunciations violating its rules, likes swearing by parents, peers,โ€ฆ..etc. Furthermore, the prophet swore oaths in different forms, guiding the hearer to the greatness of our creator. The legitimacy of oaths has great destinations like magnification, ratification, confirmation, reinforcement, persuading, prohibiting and drawing attention.
