Abstract
Praise is to Allah by whose grace good deeds are completed, because of him needs are facilitated, peace and blessings of Allah be upon prophet Mohammad, and on his family and companions.
Having said that:
This study dealt with the subject of the rules of oath in a comparative fiqh study, which is a collection of the rules in which the scholars have disagreed over in the oath chapter, and an explanation of the difference between all doctrines and weighing up what is more correct of the sayings, and I divided the thesis into the third chapters:
First Chapter: In which I talked in general about the Fiqh rule in terms of its concept, importance and argument, and showed the disagreement of the scholars over the argument of the Fiqh rule. The researcher concluded that the fiqh rule is an argument or proof with taking into consideration the Islamic texts. The researcher also talked briefly about oaths in terms of their concept, legitimacy and types.
Second Chapter: It talked about five rules of oath related to intention and pronunciation. The researcher showed the sayings of the jurists about the structure and the exemption of the oath. the researcher concluded that oaths are based on intention and purpose if the person who swore has an intention, purpose and pronunciation.
