| dc.description | This study aims at building a proposed paradigm that would reduce the murder phenomenon، committed for economic causes، in light of reality، legislation، social، and psychological theories. Qualitative، analytical approaches in addition to System Analysis Methodology were used to draw the conclusions of this research. Interviews were also used to collect descriptive data from (5) representatives of the judiciary، and reform commissions، besides specialists in criminology. After analyzing the sample’s response، the following conclusions were drawn as for the nature of the phenomenon: the reality of economic causes in Palestine، legislation، policies، and practices. Based on these pieces of information and by system analysis method the paradigm to reduce the murder phenomenon was constructed contains the inputs، process and outputs related to the phenomenon، all contents of the system are integrated with each other. Adding to the paradigm the study attained murder economic reasons including: economic motives، absence of punishing، and the absence of legislative authority in Palestine led to the absence of legislation and regulations. Based on these results researcher recommends to apply this paradigm in a complementary way and provide feedback about its components based on standards designed specifically for that. | en_US |
| dc.description.abstract | هدفت الدراسة إلى بناء تصور مقترح للحد من ظاهرة القتل لأسباب اقتصادية في ضوء الواقع، والتشريعات والنظريات الاجتماعية والنفسية، واستخدم لبناء هذا التصور البحث الكيفي والمنهج التحليلي وأسلوب تحليل النظم، واستُخْدِمَتْ أداة المقابلة لمقابلة (5) من ممثلي القضاء، ولجان الاصلاح، والمتخصصين في علم الجريمة، وعند تحليل استجاباتهم توصل الباحث إلى واقع ظاهرة القتل من حيث: دوافع جريمة القتل، والتشريعات، والسياسات، والممارسات المعمول بها، واستُخدِمَتْ أداة لتحليل نماذج من قرار الحكم، ونماذج من صك الصلح للخروج بممارسات وتشريعات وقوانين معمول بها، وهذا التحليل للنظم المختلفة (قضاء، عشائر، اختصاص علم الجريمة)، وللاستجابات في المقابلة ساعد الباحث في بناء التصور متضمناً مدخلات وعمليات ومخرجات متكاملة مع البعض، بالإضافة الى التصور، توصلت الدراسة الى أن ابرز دوافع القتل العمد: دوافع اقتصادية، وغياب قانون عقوبات يتناسب مع حجم الجريمة، وغياب السلطة التشريعية في فلسطين أدى الى غياب التشريعات والقوانين، بناء على هذه النتائج يوصي الباحث بضرورة تطبيق هذا التصور بطريقة تكاملية وتقديم التغذية الراجعة حول مكوناته بالاستناد الى معايير صممت خصيصاً لذلك. | en_US |
