| dc.description.abstract | Thank God, failed to perceive the minds of those who know, and the mighty that the hearts of the frightened fear to feel, and the greatness that have been ascribed to the faces Altaeein and engaged. If the deceased belonged to a people at war with you and he was a believer, the freeing of a believing slave (is prescribed); and if he belonged to a people with whom you have a treaty of mutual alliance, compensation (blood money - Diya) must be paid to his family, and a believing slave must be freed. And whoso finds this (the penance of freeing a slave) beyond his means, he must fast for two consecutive months in order to seek repentance from Allah. And Allah is Ever All-Knowing, All-Wise. | dc.description.abstract | الحمد لله ذي الجلال الذي عجزت عن ادراك كنهه عقول العارفين , والقدرة التي وجلت من رهبتها قلوب الخائفين ,والعظمة التي عنت لعزتها وجوه الطائعين والعاكفين, والصلاة والسلام على سيدنا محمد سيد الخلق وامام المجاهدين. أما بعد: لقد أحاط الإسلام النفس الإنسانية بهالـةٍ كبيرةٍ من الاحترام و التقدير, فجعل الاعتداء عليها جرماً عظيماً, واعتبر القتل من أشد مظاهر الاعتداء على هذه النفس , قال الله تعالى في كتابه العزيز "وما كان لمؤمن أن يقتل مؤمنا إلا خطأً ومن قتل مؤمناً خطأً فتحرير رقبة مؤمنة ودية مسلمة إلى أهله إلا أن يصدقوا فإن كان من قومٍ عدو لكم وهو مؤمن فتحرير رقبة مؤمنة وإن كان من قوم بينكم وبينهم ميثاق فدية مسلمة إلى أهله وتحرير رقبة مؤمنة فمن لم يجد فصيام شهرين متتابعين توبة من الله وكان الله عليماً حكيماً" و قال صلى الله عليه و سلم: "لزوال الدنيا أهون على الله من قتل امرئ مسلم بغير حق"، و مما يتعلق بذلك قتل المرأة خطأ فرغم وضوح حرمة قتل المرأة المسلمة , ووجوب الدية بقتلها , واجماع الفقهاء على تساوي الجرم الواقع على المرأة مع ما يقع على الرجل إلا أنهم اختلفوا في عقوبة الدية المستحقة على كل منهما، فمنهم من قال بأن دية المرأة نصف دية الرجل , و منهم من قال بأن دية المرأة تساوي دية الرجل. وما اطمأنت إليه نفسي بعد التحقيق في هذه المسألة وعرض أدلة الفريقين ومناقشتها لهذه المسألة هو أن دية المرأة المسلمة نصف دية الرجل لأن الأحاديث النبوية الشريفة يعاضد بعضها البعض وإن كانت ضعيفة، فبالتالي تكون مخصصة للأدلة العامة التي ذكرها المخالفون –القائلون بتمام الدية- هذا بالإضافة إلى اتفاق المذاهب الأربعة على التنصيف والله ورسوله أعلم. | ar |
