dc.description.abstractPraise and thanks giving to Allah, Lord of the universe, and may the peace of Allah be on our master Mohammad, on his kin and all his companions. The purpose of this study was to examine legislations pertinent to the rights of children in Islam and international conventions. It was analytical and detailed study of the extent of Islam's interest in the human being from birth to death. In its legislation Islam aims at bringing about a good human being. Furthermore, this study sought to identify areas of agreement and difference between Fiqh and law when it comes to secondary issues related to rights of children. This study fell into six major chapters. In chapter one, the researcher dwelt on the status of man in Islam. Chapter two, on childhood, illustrated the concepts of child and childhood and all terms associated with children. Chapter three, was devoted to the role of the family in building the child's personality. Chapter four tackled rights of children in Islamic Shari'a. Chapter five, on rights of children in international conventions, examined. Chapter six, on rights of children in Islamic Shari'a versus the international conventions, held a comparison between Islamic laws and common laws pertaining to rights of children before birth. The researcher at the end provided a number of recommendations in the light of her findings.en
dc.description.abstractالحمد لله رب العالمين، والصلاة والسلام على خاتم الأنبياء والمرسلين، المبعوث رحمة للعالمين، وعلى آله وصحبه أجمعين. وبعد ... فإن هذا البحث يهدف إلى دراسة التشريعات المتعلقة بحقوق الطفل في الإسلام والاتفاقيات الدولية دراسة تحليلية مقارنة توضح مدى اهتمام الإسلام بالإنسان عامة وبالطفل خاصة. كما أنها تهدف إلى التعرف على مواطن الاتفاق والاختلاف بين الفقه والقانون في المسائل الفرعية في حقوق الطفل. وقد جاء هذا البحث في ستة فصول رئيسة وخاتمة جعلت الأول منها لمكانة الإنسان في الإسلام، ولتحديد المرجعية للحقوق في الشريعة. وأما الثاني فجعلته للحديث في الطفولة ومراحلها وخصائصها والسن الذي تنتهي عنده الطفولة ورجحت اعتبار سن الخامسة عشرة الحد الأعلى لانتهاء مرحلة الطفولة. وجعلت الفصل الثالث لدور الأسرة في بناء شخصية الطفل. والفصل الرابع لحقوق الطفل في الشريعة الإسلامية. والفصل الخامس لحقوق الطفل في المواثيق الدولية . أما الفصل السادس فجعلته للمقارنة بين حقوق الطفل في الشريعة الإسلامية والاتفاقيات الدولية. ثم ختمت البحث ببيان أهم النتائج والتوصيات.ar
