dc.description.abstractThis thesis addressed the relation between Administrative Malpractice And Crime, by examines the problematic legal structure that governing this relation in the framework of the civil service. it will examine the limitations between Malpractice And Crime And highlight the Similarities and differences between them and exploring the impacts of each others. The researcher used comparative method, by comparing the Palestinian legislations with the Egyptian and Jordanian legislations to demonstrate the differences in some of the issues related to the thesis . This study was divided into two chapters, where the researcher in the first one addressed the legal status of the civil servant offense by clarifying legal status for both the Malpractice And Crime that committed by civil servant. and indicated the concept of each of them and explained elements and types of each, concluded with the most important similarities and differences between them. In the second chapter of the study researcher addressed the legal implications of the relation between the administrative malpractice and crime in the framework of the public service, by determined the authority that has the competent in implanting the administrative malpractice against the civil servant . the researcher also explained the criminal judgment of acquittal or conviction before the authority that has the competent in implanting the administrative malpractice against the civil servant. Through the whole study of the Palestinian, Egyptian and Jordanian legislations that governing the relation between the administrative malpractice and crime, the researcher founded that there were a gap and shortcomings in these legislations . comparing to the Palestinian and Jordanian legislations , the Egyptian one was more accurate by regulating many issues that the Palestinian and Jordanian legislations ignored.en
dc.description.abstractتناولت هذه الأطروحة الرابط في العلاقة بين الجريمة التأديبية والجريمة الجنائية، حيث تدور وتتمحور إشكالية هذه الدراسة حول الإطار القانوني الذي يحكم العلاقة ما بين الجريمة التأديبية والجريمة الجنائية في إطار الوظيفة العمومية، وبيان مدى تماسك وتراص البنيان القانوني لهذا الإطار وإبراز حدود العلاقة بين الجريمة التأديبية والجريمة الجنائية وأوجه الشبه والاختلاف بينهما ومدى تأثر كل جريمة منهما بالأخرى، حيث استخدم الباحث في هذه الدراسة المنهج المقارن وذلك من خلال مقارنة التشريعات الفلسطينية بنظيرتها في التشريعات المصرية والأردنية وبيان أوجه الاختلاف في بعض المسائل. وتم تقسيم هذه الدراسة إلى فصلين، حيث بين الباحث في الفصل الأول من هذه الدراسة الطبيعة القانونية لجريمة الموظف من خلال بيان ماهية كل من الجريمة التأديبية والجريمة الجنائية المرتكبة من قبل الموظف العام، حيث وضح الباحث مفهوم كل جريمة منهما وأركانها وتقسيماتها، منتهياً بالنتيجة إلى بيان أهم أوجه التشابه والتباين بينهما. وفي الفصل الثاني من هذه الدراسة تعرض الباحث إلى الآثار القانونية المترتبة على العلاقة بين الجريمة التأديبية والجريمة الجنائية في إطار الوظيفة العمومية، من خلال تحديد السلطة المختصة في ممارسة الإجراءات التأديبية في نطاق الوظيفة العامة، ومن ثم تسليط الضوء على الطبيعة القانونية للحكم الجنائي الصادر بالبراءة من المحكمة أمام السلطة التأديبية، وتبعاً لذلك كله بيان مدى حجية الحكم الجنائي الصادر بالإدانة أمام السلطة التأديبية. ومن خلال دراسة التشريعات الناظمة للعلاقة بين الجريمة التأديبية والجريمة الجنائية، تبين أن هناك بعض أوجه القصور في هذه النصوص، ومن خلال المقارنة مع التشريعات المصرية والأردنية تبين أن التشريع المصري أدق بكثير من نظيريه الفلسطيني والأردني، والذي تجاوز العديد من المسائل القانونية التي أغفلها كل من المشرعين الفلسطيني والأردني.ar
