| dc.description.abstract | This research was conducted by Faridah Hussein Taha Thaher and is supervised by Dr. Ma'moun Al-Rifa'I and is submitted as a completion of the requirements for a Master Degree from the Faculty of Higher Studies at An-Najah National University. The research is divided into four chapters and a conclusion. In the first chapter, the researcher defined financial control، its legitimacy, the objectives of the financial control system and the point of view of this system in Islam. In the second chapter, the researcher discussed the mechanisms and control methods in Islam from four different perspectives. She explained mechanisms and control methods in Islam, types of control over money (goods and prices) according to the time of the control process, types of control according to the kind of bodies that handle this task, and finally, the role of officials regarding the control process. The third chapter included the discussion of goods' provision and the role of officials in this respect. She also spoke about providing and increasing production, monopoly and its impact on the production of goods، the types of selling that are prohibited in Islam such as the kind of selling in which merchants would cheat those who come from foreign countries knowing that those people are ignorant when it comes to the local prices، and the kind of selling in which a certain good is being bid for the purpose of raising its price. In the fourth chapter, the researcher discussed pricing and the role of Al Hisba system in financial control. This included discussing pricing in Islamic Fiqh and the role of Al Hisba system in financial control. Finally، the researcher concluded the study with the most important and significant results and outcomes along with recommendations and a list of the resources to which she referred to conduct the research. | en |
| dc.description.abstract | الحمد لله ربّ العالمين والصلاة والسلام على سيد المرسلين سيدنا محمد . وبعد: فهذا البحث بعنوان: الرقابة على السلع والأسعار في الفقه الإسلامي، مقدم من الطالبة: فريدة حسني طه ظاهر، بإشراف الدكتور مأمون الرفاعي، وذلك استكمالاً لمتطلبات درجة الماجستير في كلية الدراسات العليا في جامعة النجاح الوطنيّة، وقد جاء في أربعة فصول وخاتمة. تناولت في الفصل الأوّل: التعريف بالرقابة المالية، ومشروعيتها، وأهداف نظام الرقابة الماليّة، وحكم الرقابة الماليّة في الإسلام، وذلك في أربعة مباحث توصلت فيها إلى أن الرقابة مشروعة وثابتة في كتاب الله تعالى وسنة نبيه صلى الله عليه وسلم، وأنها ضرورة شرعية من متعلقات الحكم والدولة، وأن لها أهدافاً كثيرة تتلخص في حماية الاقتصاد وحفظ الأموال العامة وغيرها. وفي الفصل الثاني: تحدثت عن آليات الرقابة ووسائلها في الإسلام، وذلك من خلال أربعة مباحث، شملت الحديث عن آليات الرقابة في الإسلام ووسائلها، وأنواع الرقابة على المال(السلع والأسعار) حسب توقيت عملية الرقابة، وأنواع الرقابة من حيث الجهة التي تتولّى عمليّة الرقابة، ودور أولي الأمر في عملية الرقابة. وفي الفصل الثالث: تحدثت عن توفير السلع ودور أولي الأمر، وذلك من خلال ثلاثة مباحث، شملت الحديث عن توفير الإنتاج وزيادته، والاحتكار وأثره على إنتاج السلع، وبيوع نهى الإسلام عنها، كبيع تلقي الركبان، وبيع النجش، وتبين لي أنه لا يتم القضاء على الاحتكارات من خلال عملية الرقابة ،كما أن الإسلام لم يهمل عملية الإنتاج بل حث على طلب الرزق ،وأوجب على ولي الأمر المسلم الاهتمام بعملية الإنتاج . وفي الفصل الرابع: تحدثت عن علاقة التسعير وجهاز الحسبة في الرقابة الماليّة، وذلك من خلال مبحثين، شملت الحديث عن التسعير وعلاقته بالرقابة المالية، ودور جهاز الحسبة في الرقابة المالية وتوصلت إلى أن الأصل في السعر الحرية وأنه لا يمكن الاستغناء عن دور جهاز الحسبة مهما بلغ التطور الاقتصادي، بل إنه موجود وإن اختلفت التسمية. ثم أنهيت البحث بخاتمة فيها أهمّ النتائج التي خلصت إليها في هذه الدراسة مع أهمّ التوصيات، والخاتمة بقائمة لأهمّ المصادر التي اعتمدت عليها في البحث. | ar |
