| dc.description.abstract | Thank God Almighty and all blessings and Glory on our Prophet, may God bless him The Islamic banks are considered as one of the good results of the Islamic rising which covered the Islamic world. And their existence is considered as economic and social necessity for Islamic society. The legal supervision is considered as the basic advantage which distinguishes Islamic Banks from the usurious banks. Because of its important role in controlling the activities of Islamic Banks from legal side, in considering that the existence of Islamic Banks is new relatively to other banks. And still Islamic Banks are facing some difficulties, and of course they need some helpers to drive it to safety place. They are members of the legal supervision. To achieve the good results from The legal supervision; there must be some contents and determinants that organize and regulate its functions and stages. So this study came to present full image about the legal supervision on the work of Islamic Banks. This study contains an introductory chapter, three main chapters, indexes and conclusion. In the introduction of this study; I spoke about its reasons and objectives, the previous studies in this topic, plan and methodology. In the introductory chapter; I explained the concept of the Islamic Banks, their origin, importance, the characteristics that distinguish them from other banks, the objectives and functions, the difficulties they face, the drawbacks, and success factors. In the first chapter; I explained the concept of the legal supervision, its nomenclature, arbitrator, importance, juristic and legal adaptation. While in the second chapter I had conversed in it about the contents of the legal supervision, and workers regulations. And in the third chapter, I spoke about the role of the legal supervision, and independence, and the compulsory of its decisions, and the difficulties which faced it, and its advantages, and its drawbacks. And I offered through the supplement four models for the regulations and laws of the legal supervision on the work of Islamic Banks. And at the end of the study I presented the most important results and recommendations. Asking God to help me. | en |
| dc.description.abstract | تعتبر المصارف الإسلامية ثمرة من ثمار الصحوة الإسلامية التي عمت أرجاء العالم الإسلامي، ويعتبر وجودها ضرورة اقتصادية واجتماعية للمجتمع المسلم. وتعتبر الرقابة الشرعية الميزة الأساسية بين المصارف الإسلامية والربوية؛ لما لها من دور هام في ضبط أنشطة المصارف الإسلامية من الناحية الشرعية، خاصة وأن تجربة المصارف الإسلامية تعتبر تجربة حديثة نسبياً، وما زالت تتلاطمها الأمواج وتحتاج إلى مخلصين يسيرونها إلى بر الأمان، وهؤلاء هم أعضاء جهاز الرقابة الشرعية. وحتى تؤتي الرقابة الشرعية أُكلها لا بد من توفر مكونات ومحددات تضبط وتنظم مهامها ومراحلها؛ فكانت هذه الدراسة لعرض صورة متكاملة عن الرقابة الشرعية على أعمال المصارف الإسلامية. وقد جاءت هذه الرسالة في مقدمة، وفصل تمهيدي، و ثلاثة فصول رئيسة، وملاحق، وخاتمة. حيث تحدثت في مقدمة هذا البحث عن مبرراته وأهدافه، والدراسات السابقة في موضوعه، وخطته ومنهجيته. وبينت في الفصل التمهيدي مفهوم المصارف الإسلامية، ونشأتها، وأهميتها، وخصائصها التي تميزها عن غيرها من المصارف، وأهدافها، ووظائفها ، والصعوبات التي تواجهها، والمآخذ عليها، وعوامل نجاحها. وبينت في الفصل الأول مفهوم الرقابة الشرعية، وأهميتها. ومسمياتها، وحكمها، وتكييفها الفقهي والقانوني. وأما الفصل الثاني فقد تحدثت فيه عن مكونات الرقابة الشرعية، وضوابط العاملين فيها. وتكلمت في الفصل الثالث عن دور الرقابة الشرعية، واستقلاليتها، وإلزامية قراراتها، والصعوبات التي تواجهها، وإيجابياتها، والمآخذ عليها. وعرضت في الملحق أربعة نماذج لأنظمة وقوانين الرقابة الشرعية على أعمال المصارف الإسلامية. و في ختام الرسالة عرضت أهم ما توصلت إليه من نتائج وتوصيات. أسأل الله الهداية والتوفيق، إنه سميع مجيب. | ar |
