dc.description.abstract	Praise is to God who guides, peace and blessing be upon the messenger of guidance , and his family and companions. Having said so : This research dealt with the provisions of the implicit divorce , and what is stated in the Palestinian personal status law that is applied in the west Bank. In the first chapter , I showed the definition of divorce in language and idiom , and with the four jurists; then its legitimacy from the Quran and Sunnah. In this chapter also, the research dealt with the kinds of divorce by looking at suspension and adding, and its kinds in term of the effect derived from whether it is final or revocable. I also showed its provisions ,the jurists' opinions and the personal status law in it. In the second chapter , the research dealt with the implicit divorce in detail in term of the definition , opinions of the jurists and their differences in stipulation the intention, presumption and case indication to the incidence of the implicit divorce; in this chapter , I mentioned the cases of the implicit divorce :the case of satisfaction, anger ,dispute ,force .Then the research dealt with the provisions of implicit divorce in term of its suspension and giving the wife the choice in divorce , when does this kind of divorce fall? And what is the kind of divorce that falls? And what is the number of divorces that fall ? In the third chapter , the research showed the most common and current implicit utterances . From these utterances : utter of charity , and word of buy and sell, utter of your choice is with your hand , the wife's saying I chose my self , the swear with divorce , utter of thehar with divorce intention , compensated divorce , and addition the divorce not to the place of the wife. Then , I mentioned some of the contemporary applications on the implicit divorce , and the jurists' opinion in them. Then , I ended the research with a conclusion ,and the most important results and recommendations .At the end, the research pointed to the resources that have been used in its writing.	en
dc.description.abstract	الحمد لله الذي هدى، والصلاة والسلام على رسول الهدى، وعلى آله وصحبه ومن بهم اقتدى، وبعد: فقد تناولت في هذا البحث أحكام طلاق الكناية، وما نص عليه قانون الأحوال الشخصية الفلسطيني المعمول به في الضفة الغربية، حيث بينت في الفصل الأول تعريف الطلاق في اللغة، والاصطلاح، وعند الفقهاء الأربعة، ثم مشروعيته من الكتاب والسنة والمعقول، وتناول البحث في هذا الفصل أنواع الطلاق من حيث حكمه، وأنواع الطلاق بالنظر إلى التنجيز والتعليق والاضافة، وأنواعه من حيث الأثر الناتج عنه هل هو بائن أو رجعي؟، وبينت أحكامها وآراء الفقهاء، وقانون الأحوال الشخصية فيها. وفي الفصل الثاني تناول البحث طلاق الكناية بالتفصيل، من حيث التعريف، وآراء الفقهاء واختلافهم في اشتراط النية، والقرينة ودلالة الحال لوقوع طلاق الكناية، حيث ذكرت في هذا الفصل حالات طلاق الكناية: حالة الرضا، والغضب، والخصومة، والإكراه، والحالة عند مذاكرة الطلاق، ثم تناول البحث أحكام طلاق الكناية من حيث تعليقه، وتخيير الزوجة في الطلاق، ومتى يقع هذا النوع من الطلاق؟ وما هو نوع الطلاق الذي يقع؟ وما هو عدد الطلقات التي تقع؟. وأما في الفصل الثالث فقد بينت أهم ألفاظ الكناية شيوعاً، وتداولاً، ومن هذه الألفاظ: لفظ الهبة، والخلية، والبرية، وألبتة، ولفظ البع والشراء، ولفظ أمرك بيدك، وقول الزوجة: اخترت نفسي، ولفظ علي الحرام، والحلف بالطلاق، وهما الأكثر تداولاً بين الناس، ولفظ أمرك بيد، ولفظ الظهار مع نية الطلاق، واللفظ الذي لا يشبه الطلاق ولا يدل على الفراق، وطلاق الأعجمي والطلاق على الإبهام، والطلاق بلفظ الخلع، وإضافة الطلاق إلى غير محل الزوجة، ثم ذكرت بعض التطبيقات المعاصرة على طلاق الكناية، ورأي العلماء فيها. ثم أنهيت البحث بخاتمة، وأهم النتائج والتوصيات التي خرج بها البحث، وفي النهاية أشرت إلى المصادر التي تم الرجوع إليها في كتابته.	ar
