| dc.description.abstract | My Master’s Dissertation had addressed the provisions of horses in Islamic Sharia, and it contained a preliminary chapter and four other main chapters. My aim from the preliminary chapter is to present to the reader a brief history of the horse and its’ importance for Arabs before and after Islam. It also discussed the definition of Horse, words related to it, types and their names in terms of age. In the first chapter: I pointed at the Quran Verses that mentioned the horse directly or implicitly, besides the Hadith Al-Shareef the confirms the legality of owning a horse. After that, I pointed at some of the horse’s virtues in Islam and how it showed the importance of owning a horse. In the second chapter: I turned into some of the provisions on horse crossbred, where I pointed at the types of crossbreeding and its legality, beside the sayings of the scholars in the most important provisions related to horses, and the sanctity of accepting payment for switch-grass stallion, and the sanctity of purchasing and selling the stallion water, and the sanctity of selling or purchasing or the exception of the pony while still in the horse’s belly. I also found that It is not preferable to load the donkeys on the back of the horse, and the legality of horse castration according to scholars, only if it was for purposes beneficial to Muslims. The third chapter: I discussed the horse competitions and its legality, conditions and the winning criteria. Then I pointed at the names of the horses gathered in the horse betting, I also pointed at the legality of the prize when the conditions from Quran and the Sunnah are present. I also presented a glimpse of the modern horse competitions. The fourth chapter: It is the last chapter, and it consists of three sections: I discussed the provision of Horse Zakat in the first section, and I reached that the Zakat of the horse prepared for trading is legal, where the Zakat of the service horse or the owned horse is illegal. The second section: I presented the legality of horse meat eating with conditions and with the purity of its waste, and that is according to the perspectives of the scholars. The third section: It contained the prohibition of killing the horse that has no hope in recovery – accept in some exceptional cases and with conditions. | dc.description.abstract | تناولت هذه الرسالة أحكام الخيل في الشريعة الإسلامية، وقد احتوت على فصل تمهيدي وأربعة فصول أخرى، وقد هدفتُ أن أبين للقارئ في الفصل التمهيدي لمحة تاريخية موجزة عن الخيل، ومدى أهميتها عند العرب قبل وبعد الإسلام، وتناولت فيه مفهوم الخيل، والألفاظ ذات الصلة، وأنواعها، وأسماءها من حيثُ السن. وفي الفصل الأوًّل: أشرت إلى الآيات القرآنية الكريمة التي ذكرت الخيل صراحة أو ضمناً، والأحاديث الشريفة التي تؤكد مشروعية اقتناء الخيل، ثم أشرت إلى بعض فضائلها في الإسلام، ومدى ترغيبه في اقتنائها. وفي الفصل الثاني: تطرقتُ إلى بعض الأحكام المتعلقة بتهجين الخيل، حيث أشرتُ إلى أنواع التهجين وجوازه، وأقوال الفقهاء في أهم الأحكام المتعلقة بالخيل، وحرمة أخذ الأجرة على عسب الفحل، وحرمة بيع وشراء ماء الفحل، وحرمة بيع ،أو شراء ، أو استثناء الحمل وهو في بطن الفرس، كما توصلتُ إلى عدم استحباب إنزاء الحمير على الخيل، وجواز خصاء الخيل عند الفقهاء إذا كان لغايات نافعة للمسلمين. وأما في الفصل الثالث: فقد تناولت المسابقات بين الخيول، ومشروعيتها، وشروطها، والمعتبر في السبق (معيار الفوز)، ثم أشرت أيضاً إلى أسماء الخيل التي تُجمع في رهان الخيل، وكذلك بينتُ مشروعية الجائزة عند توفر شروطها المستنبطة من الكتاب الكريم والسنة الشريفة، وتناولت لمحة عن مسابقات الخيل المعاصرة. وأما الفصل الرابع: وهو الأخير فقد اشتمل على ثلاثة مباحث: المبحث الأوَّل تناولتُ فيه حكم زكاة الخيل، وتوصلت فيه إلى وجوب زكاة الخيل السائمة أو المعدة للتجارة، وعدم وجوب الزكاة في الخيل غير السائمة أو المعدة للخدمة، أو للقنية، أما المبحث الثاني: فقد بينتُ إباحة أكل لحم الخيل بشروط، وطهارة فضلاته حسب الراجح من آراء الفقهاء في ذلك، وأما المبحث الثالث: فقد اشتمل على تحريم قتل الخيل الذي لا يرجى شفاؤه،- إلا في بعض الحالات الاستثنائية، وبشروط، وتحريم تعذيب الخيول والدواب. | ar |
