dc.description.abstractThe aim of the study is to examine the reliability of audited financial statements in Palestinian income tax departments. This includes balance sheet, income statement and cash flow statement; the study begins with the preparation of the financial statements by the company's management based on the general accepted accounting principles "GAAP". These financial statements will be subjected to audit based on the general accepted auditing standards "GAAS". When reaching the assessor, these financial statements will be subjected to tax liability estimate based on the tax law and other related regulations. The study consists of four chapters, each one includes several topics, the first chapter deals with the need for financial statements, the accounting system and it's components, the importance and the objectives of the financial statements in Palestine, the basic assumptions for the preparation of the financial statements, the components of these financial statements, the users of these financial statements, the characteristics of these financial statements, the restrictions imposed on the preparation of these statements and the general accepted accounting principles. The study consists of four chapters, each one includes several topics, the first chapter deals with the need for financial statements, the accounting system and it's components, the importance and the objectives of the financial statements in Palestine, the basic assumptions for the preparation of the financial statements, the components of these financial statements, the users of these financial statements, the characteristics of these financial statements, the restrictions imposed on the preparation of these statements and the general accepted accounting principles. The second chapter starts with the definition of the term "Audit" and it's types and objectives. It also investigate the following topics: the general accepted auditing standards, the independency of external auditor, accounting and audit status in developing countries, audit means and examples on some audit programs, the expectation gape facing the users of these audited financial statements and the auditors pitfalls and the subsequent legal responsibility. The third chapter deals with the following topics: the differences between accounting profit and taxable profit by giving an example of how to find out the taxable profit from accounting profit, it also shows the importance of implementation to the international accounting standard No.(12), self-estimate of Palestinian share holding companies, estimate methods in the Jordanian tax law, modern techniques for tax – estimate, work procedures of the assessors in Palestine (interviews were held with Palestinian assessors for clarification), tax audit techniques on the income of Palestinian share holding companies, links between international audit standards and tax audit procedures and the success requirements of sample Tax audit. The fourth chapter studies three real financial statements for real limited liability companies; taken from the tax departments settled files. the related financial statements have been selected based on specific criteria to represent the real life. These cases have been presented in a way to show the difference between actual a mount paid by the tax payer and the expected amount that should be paid if related financial statements were accepted by assessor. This chapter also shows the reasons behind the rejection of audited financial statements by the assessor. The researcher concludes the study by the following major recommendations: 1.Written and documented procedures should be available at the Palestinian tax income departments as guidelines to assessor. 2.Mistrust between assessor and tax payer should be removed. 3.Electronic auditing techniques should be followed in Palestinian tax income department. 4.Real implementation of tax fines on auditor and tax payer when violating tax laws. 5.Accounting and audit profession should be improved and developed by introducing suitable local audit and accounting standards in Palestine. 6.International Accounting Standard No. (12) should be followed in preparing financial statements. 7.Tax awareness should be increased by holding conferences, workshops, meetings, issuing periodicals and other suitable means. 8.Adequate training to auditor and assessor is required to improve their performance. Finally,the researcher hopes that the above mentioned recommendations should be seriously followed in order to enhance the credibility of audited financial statements in Palestinian tax income departments.en
dc.description.abstractترتكز هذه الدراسة على قياس مدى مصداقية البيانات المالية المدققة المتمثلة في الميزانية العمومية وقائمة الدخل وقائمة التدفق النقدي، بدءا من تحليل وتسجيل وتبويب وتصنيف الأحداث الاقتصادية، وصولاً إلى إعداد البيانات المالية والتي تمثل الناتج النهائي للعمل المحاسبي وفقاً للمبادئ المحاسبية المتعارف عليها، ومروراً بتدقيق البيانات المالية من قبل مدقق حسابات خارجي مستقل ومحايد، لإعطاء رأيه المهني حول مدى صحة تمثيلها لواقع الشركة المالي ونتيجة أعمالها وذلك وفقاً لمعايير تدقيق متعارف عليها. وإذا قلنا أن المدقق يبدأ عمله من حيث انتهى المحاسب، وأن مأمور التقدير يبدأ عمله أيضاً من حيث انتهى المدقق، فإن الإقرار الضريبي يبدأ من حيث انتهى بيان الدخل، وأن ما يدخل عليه من تعديلات لاحقة ما هي إلا تعديلات تتم وفقاً للقانون الضريبي المعمول به، وما جرى عليه العمل هو وفقاً لمعايير المحاسبة المتعارف عليها، أما رفض البيانات المالية المدققة، من قبل مأمور التقدير فما هو أيضاً إلا تجسيداً لعدم قناعته بصحتها او لعدم ثقته في معدي هذه البيانات من محاسب ومدقق. لقد تم تقسيم هذه الدراسة إلى أربعة فصول، يحوي كل منها عدة مباحث، حيث عالج الفصل الأول البيانات المالية التي يتم إعدادها من قبل المحاسب من خلال نظام محاسبي، وتم بيان أهمية هذه البيانات ومدى الحاجة إليها والافتراضات الأساسية لإعدادها ومكوناتها، ومستخدميها، والقيود المفروضة على إعدادها والمبادئ المحاسبية التي تعد وفقاً لها. أما الفصل الثاني فقد عالج موضوع تدقيق البيانات المالية وأنواعه وأهدافه والمعايير المتعارف عليها لتنفيذه، وأهمية استقلالية مدقق الحسابات الخارجي وإجراءات عمله من خلال إعطاء أمثلة على برامج التدقيق المستخدمة في مكاتب التدقيق الدولية مع إعطاء نبذة عن واقع المحاسبة والتدقيق في مناطق السلطة الوطنية الفلسطينية، وفجوة التوقعات من مستخدمي البيانات المالية المدققة، والمسؤولية القانونية المترتبة على أخطاء المدقق. أما الفصل الثالث فقد عالج مثال عملي يبين استخراج الربح المحاسبي من الربح الضريبي، إضافة إلى إظهار الفروقات بين الربح المحاسبي والربح الضريبي، وتسليط الضوء على مدى أهمية تطبيق معيار المحاسبة الدولي رقم (12) لدى إعداد البيانات المالية، وتم تبيان كيف يتعامل مأمور التقدير مع البيانات المالية المدققة من خلال مقابلات شخصية مع بعض مأموري التقدير العاملين في دوائر ضريبة الدخل الفلسطينية، مبيناً إجراءات العمل الذي يقومون بها بدءاً من استلامهم للبيانات المالية وانتهاءاً بتقدير مبلغ الضريبة. ولم يغفل الباحث عن التوجهات الحديثة في تقدير ضريبة الدخل والمتمثلة في التقدير الذاتي، والأساليب الحديثة للفحص الضريبي مبيناً نقاط الترابط بين إجراءات الفحص الضريبي ومعايير التدقيق الدولية، ومقومات نجاح الفحص الضريبي، والضوابط والمؤشرات الواجب أخذها بعين الاعتبار من قبل مأمور التقدير. أما الفصل الرابع والذي يمثل الواقع العملي والجانب التطبيقي، فقد تم أخذ بيانات مالية مدققة من ميزانية عمومية وقائمة دخل لثلاث شركات مساهمه خصوصية وحقيقية من واقع ملفات دائرة ضريبة الدخل الفلسطينية، حيث تم مراعاة أسس معينة لاختيار تلك الشركات المساهمة لتكون عينة ممثلة للواقع الفعلي، مثل اختلاف طبيعة نشاط الشركة، اختلاف أسباب الرفض، اختلاف مأموري التقدير واختلاف المدقق الخارجي للبيانات المالية المدققة، حيث تم عرض كل حالة عملية في هذه الدراسة بشكل يبين المعلومات العامة عن الشركة، ونوع التقرير الصادر بشأن بياناتها المالية، إضافة إلى إرفاق البيانات المالية من ميزانية عمومية، وقائمة دخل وتفصيل للمصاريف الإدارية والعمومية، وتم بيان أسباب الرفض من قبل مأمور التقدير، ونوع الرفض فيما لو كان رفضاً كلياً أو جزئياً، وتم أيضا احتساب المبلغ المفترض دفعه لو تم اعتماد البيانات المالية كما هي، ومقارنته مع المبلغ المدفوع فعلاً من قبل المكلف، وبيان الأساس الذي تم الاحتساب بموجبه للمبلغ المدفوع، منهيا الفصل فيما تم استخلاصه من واقع دراسة الحالات العملية. وفي نهاية هذه الدراسة خرج الباحث بعدد من التوصيات كان من أبرزها: 1. ضرورة وجود إجراءات فحص ضريبي مكتوبة وموثقة في دوائر ضريبة الدخل الفلسطينية. 2. حل أزمة الثقة بين المكلف والدوائر الضريبية من خلال تبني دوائر ضريبة الدخل الفلسطينية لمبدأ أن المكلف صادق ما لم يثبت عكس ذلك، وحث المكلفين على إمساك سجلات محاسبيه لأن في ذلك التطبيق الفعلي للقانون وخطوة هامة نحو التخلص من التقدير الجزافي. 3. استخدام أسلوب المراجعة الالكترونية في الدوائر الضريبية. 4. عدم التهاون في تنفيذ العقوبات الضريبية على كل من مدققي الحسابات والمكلفين. 5. تطوير مهنة المحاسبة ومهنة التدقيق من خلال إيجاد معايير تدقيق ومعايير محاسبية محلية. 6. ضرورة الأخذ بمعيار المحاسبة الدولي رقم (12) الخاص بضرائب الدخل لما في ذلك من أهمية. 7. تنمية الوعي الضريبي من خلال إقامة الندوات، ورشات العمل .... الخ، والعمل على تأهيل وتدريب كل من المدققين ومأموري التقدير بشكل كافٍ، خاصة ان تدقيق البيانات المالية المقدمة من الشركات المساهمة يحتاج الى نوعية متخصصة ومتدربة جداً من المدققين وفاحصي الضرائب. ويأمل الباحث ان يكون لهذه التوصيات وغيرها مما ورد في هذه الدراسة اثر بالغ وفعال - اذا ما اخذ بها- في تدعيم الثقة وزيادة المصداقية في البيانات المالية للشركات المساهمة من قبل دوائر ضريبة الدخل الفلسطينية.ar
