| dc.description.abstract | Praise be to God and prayer and peace on the honest guider Prophet and after,,, This research comes as a completion to the Master's degree in the Department of Jurisprudence and Legislation at An- Najah National University, it has included four chapters, where it deals with the concept of equality and words related to the then status of the family in Islam by addressing the foundations of the family system and its definition language idiomatically, and highlight its importance as Islam is keen on its success. This study examined the rules of selection of the couple and its impact on the boys showed tremendous benefits that are achieved as a result of the increase of the number of children, also the study dealt with taking care of the fetus and the right of the child in breast-feeding and the position of the scholars about its obligatory on the mother, the study as well examined the role of the home in educating young children through focusing on the role of parents and the mother's non- preoccupation with work, and illustrated the importance of closer links between the home, the school and the mosque for the benefit of children. The study continued to discussing the Islamic curriculum and its characteristics and objectives that will refine the child's personality, that makes him guided by the command of Allah - the Almighty - and characterized by high moral. After that, the study addressed the core issue of equality between children in rights including his right in Adan in their ears and stay in his ear at birth, tahnik, the right to be attributed to his parents, to be given a good name and and circumcised. The study highlighted how to achieve equality and justice among the children by their parents in such matters and others, such as their right in living costs , treatment costs , and discipline and education. The research discussed the foqaha' views around the right of equality between children in gifts in both its material and moral terms were penalties Based on the evidence in this regard. The study took evidence of the need to achieve justice and equality among the children in inheritance and marriage costs with examples on the inheritance of the reality of what is happening such as irregularities in the failure to achieve equality between brothers and sisters, and then the study focused on the causes of deviation of the children by showing some of the causes among children such as bad treatment of them by parents and divorce cases. The study dealt with the remedies to take care of the children physically, psychologically and spiritually as well as removal of the causes of envy by not making preference among them and by directing them toward public morality such as spreading peace and authorization to enter the houses and ignoring the sight, and to avoid that which is contrary to these rules such as backbiting and gossip, lying, joking, and others. It became clear through the study that the main purpose of the equality between children is the commitment of the command of Allah - the Almighty - and sustaining the affection and love between children and their parents and strengthening links within families and the Muslim community as a whole. | en |
| dc.description.abstract | الحمد لله رب العالمين والصلاة والسلام على الرسول الهادي الأمين وبعد: فإن رسالتي هذه تأتي استكمالاً لنيل درجة الماجستير في قسم الفقه والتشريع في جامعة النجاح الوطنية، وقد تضمنت أربعة فصول، حيث تعّرضت الدراسة لمفهوم المساواة والألفاظ ذات الصلة بها ومن ثم مكانة الأسرة في الإسلام من خلال التطرق إلى أسس نظام الأسرة وتعريفها لغةُ واصطلاحاً، وإبراز ما لها من أهمية حيث حرص الإسلام على نجاحها. هذا وتناولت الدراسة قواعد اختيار الزوجين، وأثره على الأولاد، وأظهرت الفوائد الجمّة التي يتم تحقيقها نتيجة تكثير الأولاد، كما تعّرضت الدارسة للعناية بالجنين وحق الطفل في الرضاعة الطبيعية وموقف الفقهاء حول وجوبها على الأم، وقد تناولت الدراسة دور البيت في تربية النشئ من خلال التركيز عل دور الوالدين وعدم انشغال الأم بالعمل عن صغارها، وبينت بنفس المضمار أهمية توثيق الصلات بين كلٍ من البيت والمدرسة والمسجد لصالح الأولاد، هذا واستكملت الدراسة الحديث عن المنهاج الإسلامي وخصائصه وأهدافه التي من شأنها أن تصقل شخصية الولد، حيث تجعله منقاداًَ لأمر الله تعالى ومتحلياً بالخلق الرفيع. بعد ذلك تناولت الدراسة جوهر الموضوع المساواة بين الأولاد في الحقوق حيث تندرج تحته حقه في الأذان والإقامة في أذنه عند الولادة وتحنيكه، وحقه في أن ينسب لوالدية وأن يسمى اسماً حسناً، ويعقّ عنه ويختتنَ، وأبرزت الدراسة كيفية تحقيق المساواة والعدل بين الأولاد من قبل والديهم في مثل هذه الأمور وغيرها، كحقهم في النفقة والعلاج والتأديب والتعليم. وتعرّضت الدراسة إلى آراء الفقهاء حول المساواة بين الأولاد في العطايا بجانبيها المادي والمعنوي، حيث تم الترجيح بناءً على ما ورد من أدلة بهذا الشأن. واستشهدت الدراسة بالأدلة على ضرورة تحقيق العدل والمساواة بين الأولاد في الميراث وتكاليف الزواج مع ضرب أمثلة على الميراث من الواقع لما يحدث من مخالفاتٍ في عدم تحقيق العدالة والمساواة بين الإخوة والأخوات. وبعدها تمحورت الدراسة حول أسباب انحراف الأولاد بإظهار بعض أسبابه لدى الأولاد كسوء المعاملة لهم من قبل الوالدين وحالات الطلاق. وتناولت الدراسة سبل المعالجة الاعتناء بالأولاد مادياً ونفسياً وروحياًَ، وكذلك إزالة أسباب التحاسد بعدم التفضيل بينهم، وتوجيههم نحو الآداب العامة كإفشاء السلام والاستئذان بالدخول على البيوت وغض البصر واجتناب ما ينافي هذه الآداب كالغيبة والنميمة والكذب والمزاح وغيرها. لقد اتضح من خلال الدراسة أن المقصد الأساسي في المساواة بين الأولاد هو التزام أمر الله تعالى وإدامة المودة والمحبة بين الأولاد ووالديهم وتقوية الصلات داخل الأسر والمجتمع المسلم ككل. | ar |
