| dc.description.abstract | Abstract I attempted in this study the subject (The Provisional Sales and Their Contemporary Applications in Light of Islamic Jurisprudence). In the beginning, I attempted the concept of sale of provisionals, its status and its relevance to the current financial crisis and concluded that sale of provisionals which prohibited according to Islamic Shariais that which includes exhubirentintrest and that contributed to the current financial crisis. I tried some of the execptions of sale of provisionals which are permissible such as contracts of settlement and manufacturing which contribute to economic revival. After that, I explore other forms of sale of provisionalsand their modern applications such as foreign trade, agriculture and sale of debts. | en |
| dc.description.abstract | الملخص تناولت في هذه الدراسة موضوع (بيع المعدوم وتطبيقاته المعاصرة في ضوء الفقه الإسلامي)، وقد تكلمت في البداية عن مفهوم بيع المعدوم وحكمه وحكمة منعه، وتوصلت إلى أن بيع المعدوم المحرم شرعاً هو المشتمل على غرر فاحش. من ثم تحدثت عن بعض الاستثناءات التي تمثل صوراً جائزة من بيع المعدوم، كعقدي السلم والاستصناع ونحوهما مع بيان إمكانية تطبيقها في شتى المجالات بما يضمن تحقيق النهوض الاقتصادي. وبعد ذلك جاء الحديث عن صور أخرى جائزة من بيع المعدوم وتطبيقاتها المعاصرة كما هو الحال في مجال التجارة الخارجية والزراعة وبيع الديون. كما تناولت الكلام عن الأزمة المالية المعاصرة وعلاقتها ببيع المعدوم، وتوصلت إلى أن بيع المعدوم بالصورة المنهي عنها كان من أهم أسباب الأزمة المالية العالمية. | ar |
