dc.description.abstractThe researcher has concerned with the meanly of the conciliation in language and AL-shareah then the researcher has clarified the importance ,the main elements and the aim of this contract. The researcher clarified the structure of this contract in some financial treatment in the Islamic feqh . Whether they are in exchanging contract , aid contract or the treatments that are constructed on the marriage contract or the financial treatments that follow the death. The researcher has concluded his study talking about the main effects of this contract, there tolled about the dropping and the obligatory of this contract , furthermore he talks about canceling it , there he implied practical issues about this contract.en
dc.description.abstractتناولت في بحثي هذا مفهوم عقد الصلح في اللغة والاصطلاح، ومن ثم وضحت أركانه وبينت أهميته والحكمة من مشروعيته. ووضحت فيه كذلك مفهوم المعاملات المالية في اللغة والاصطلاح ، وبينت بشكل مختصر مجالات المعاملات المالية، ومجالات الصلح في هذه المعاملات. كما بينت فيه كذلك أحكام عقد الصلح في بعض المعاملات المالية في الفقه الإسلامي سواء في عقود المعاوضات أم في عقود التبرعات والأمانات، والمعاملات المترتبة على عقد الزواج، أو المعاملات المالية المترتبة على الوفاة. وختمت هذه الرسالة بالحديث عن أهم الآثار المترتبة على عقد الصلح، من حيث الإبراء والإسقاط، وإلزامية عقد الصلح، وفسخ عقد الصلح أو بطلانه، ومن ثم ضمنته تطبيقات عملية لعقد الصلح في المعاملات المالية.ar
